§ 24-8. Review of false alarm determinations.

  • (a)

    Request for review. The alarm systems coordinator shall, when requested by an alarm user, review the determination that an alarm was false. Such review shall be conducted by the alarm systems coordinator only if the alarm user requests in writing such a review within ten days of the date the alarm user was notified of the false alarm determination. The written request for review of a false alarm determination by the alarm systems coordinator shall include the following information:

    (1)

    Alarm user name;

    (2)

    Address at which alarm is installed;

    (3)

    Date of false alarm that is being contested;

    (4)

    Facts upon which the request for review of the false alarm determination is made.

    (b)

    Decision of the alarm systems coordinator. The alarm systems coordinator shall render a decision within 30 days after the date of submission of the written request for review of a false alarm determination. If the appeal is denied, the alarm systems coordinator shall send written notice by certified mail to the appellant of the decision and a statement of the right to further appeal. An alarm user may appeal the decision of the alarm systems coordinator to the board of commissioners by filing a written request within 20 days of the date of the decision by the alarm systems coordinator. The board of commissioners shall conduct a hearing and consider evidence presented by interested parties. The board of commissioners shall make its decision on the basis of a preponderance of evidence presented at the hearing and shall render a decision within 30 days after the hearing. The board of commissioners shall affirm or reverse the action of the alarm systems coordinator. The filing of a request for appeal to the board of commissioners shall stay an action by the alarm systems coordinator until the board of commissioners reaches a decision. If a request for appeal is not made to the board of commissioners within the 20-day period, the decision of the alarm systems coordinator will be final.
