§ 32-3. Tasting rooms.

  • Tasting rooms shall be lawful in the unincorporated area of the county, and shall be governed by this chapter in conjunction with the provisions of O.C.G.A. § 3-6-21.1, et seq. and chapter 10, Alcoholic Beverages of this Code. Tasting rooms shall be located on or contiguous to property that has been approved for a conditional use as a farm winery by the county board of commissioners under chapter 62, article II, Land Use Ordinance of Gilmer County, Georgia. Only one tasting room shall be located on the licensed premises of the farm winery. For purposes of this section, the term "licensed premises" shall mean the premises for which the farm winery license is issued or property located contiguous to the farm winery and owned by the farm winery. There must be an active ongoing operation occurring on said property at all times. No residence may be located on the same property as the tasting room.
