§ 46-62. Application requirements for landfill or waste disposal site.

  • (a)

    Generally. Application for a landfill or waste disposal system permit shall be made to the board of commissioners. This application requirement may be satisfied by submitting copies of all current state and federal applications and permits for the landfill or waste disposal system operation to the board of commissioners.

    (b)

    Qualifying systems. The landfill or waste disposal system permit shall be granted as to any landfill or waste disposal system qualifying under this article, which, as of the effective date of the ordinance from which this article is derived, (i) is a lawful operation in full operation pursuant to all applicable federal and state laws as well as county ordinances, or (ii) has been established by means of a final decision of a court of competent jurisdiction. Permitting of existing landfills and waste disposal systems under this article shall be for the purpose of administration and maintaining of information on operations including coordination with state and federal officials to determine if any nonconforming act has been committed and/or has ended.

    (c)

    Applicability.

    (1)

    No new landfill or waste disposal system shall be commenced within the county until a landfill or waste disposal permit has been issued by the board of commissioners.

    (2)

    Any expansion of an existing landfill or waste disposal system shall be considered as a new landfill or waste disposal system and shall be subject to all the requirements listed in this article for new landfills and waste disposal systems.

    (3)

    All permits shall be renewed every year by making application for renewal to the board of commissioners.

    (4)

    Renewal of a permit does not require rehearing.

    (5)

    The cost of a permit shall cover costs of administration and inspection and shall be set by the board of commissioners.
