§ 46-66. Other limitations and prohibitions on operations.

  • (a)

    The location, the boundaries and the proposed method of operation are required to be approved by the county engineer, whose services shall be paid for based on fees as set by the board of commissioners for plan reviews, inspection and investigation.

    (b)

    Truck traffic routes and entrances to the facility to be approved by the county engineer. Acceleration and deceleration lanes and widening of roads for sight distance shall be required based on the county engineer's report as to what is required for safety. The landfill or waste disposal system shall be accessible without excessive travel over residential streets.

    (c)

    No sanitary waste shall be disposed of within 100 yards of the public highway, a residence, church, cemetery, or other public gathering place.

    (d)

    As a condition of the permit issuance and continuance, and in keeping with government intention that waste be recycled, at any time the following items are separated from waste which is permitted, these items shall not be placed in any landfill or waste disposal system in the county, and certified statements and proof of recycling carried out may be required monthly or less by the public works director: paper products, plastic, yard waste and yard trash, aluminum, glass, plastic, vehicle tires, ferrous and nonferrous metal, and batteries.

    (e)

    Waste of a type which is not permitted at a particular landfill or waste disposal system and which comes onto the site incidentally discovered in waste which is permitted must be removed from the landfill or waste disposal system site daily.

    (f)

    No landfill or waste disposal system shall be located within 10,000 feet of any airport runway used by turbojet aircraft or within 5,000 feet of any airport runway used by only pistoned-type aircraft.

    (g)

    No landfill or waste disposal system shall be located in any wetland, or area being designated as 100-year floodplain or within 300 yards of a trout stream.

    (h)

    A landfill or waste disposal system may not be located on a tract of less than 20 acres and the landfill or waste disposal system site permitted may not exceed five acres.

    (i)

    The landfill or waste disposal system shall not be located near a significant groundwater recharge area.

    (j)

    The landfill or waste disposal system shall not be situated within two miles upgradient of any surface water intake for a public drinking water source.

    (k)

    There shall be a minimum of 100 feet buffer area between the property line and the waste disposal boundary line. No clearing and grubbing are to take place in these areas except as required for the construction of drainage devices, groundwater monitoring wells, and no access roads as a part of the 100-foot buffer.

    (l)

    Permits are not transferable by the applicant without application to and approval by the board of commissioners in the case of use exceptions granted by the board of commissioners. The applicant shall have the burden of proving ability to comply with the requirements of the board of commissioners and applicable state, federal, and local laws, ordinances, and regulations before approval is granted.
