§ 46-107. Waste acceptance policy and regulations.

  • In all cases priority will be given to domestic waste, industrial waste, and commercial waste generated in the county.

    (1)

    Domestic and commercial solid waste. Only domestic and commercial solid waste generated within the county is permitted to be disposed of at the county landfill and the valid tipping fee for this type of waste will be charged. All waste disposal sites and/or facilities within the county are authorized to accept only waste which has been documented as having been generated within the county.

    (2)

    Residual waste. It is the intention of the board of commissioners to accept only residual wastes which have been approved by the state environmental protection division and deemed appropriate by the landfill. All such waste will be evaluated as the origin, chemical composition, quantity and tipping fee.

    (3)

    Hazardous waste. No hazardous waste will be accepted. No person shall deposit or attempt to deposit hazardous waste on the county landfill's property. No material other than commercial or municipal waste or residual waste that has been approved by state department of natural resources, environmental protection division, and the board of commissioners may be deposited at the landfill.

    (4)

    Hospital waste. No infectious hospital waste will be accepted. Noninfectious hospital waste will be accepted from hospitals within the county only. Processed pathological wastes from nonhospital generators will be evaluated, accepted or disallowed on an individual basis.

    (5)

    Patient care waste. Patient care waste, as defined by the state department of natural resources, environmental protection division, will be accepted only if a manifest is submitted to the landfill at the time the patient care waste is brought into the landfill. Only patient care waste generated in the county will be accepted. To the extent that patient care waste is hazardous or infectious waste, it will not be accepted by the landfill.

    (6)

    Asbestos. Asbestos must be wetted and bagged in 12 mil (minimum) thickness polyethylene bags or must be wetted, packed in six mil polyethylene bags in fiber drums. Only asbestos waste generated in the county may be accepted. State department of natural resources, environmental protection division rules and regulation must be followed with respect to wetting and bagging the materials, etc. Materials must be wet when received at the county landfill.

    (7)

    Bulky waste. Bulky waste will be accepted if generated in the county.

    (8)

    Construction and demolition waste. Construction and demolition waste, which originates in the county will be accepted if it does not contain any residual waste or industrial waste components.
