Where there is a written request to the planning commission not less than 30 days
prior to submission of the preliminary plat or if the variance was unforeseeable at
the preliminary plat approval time, such variance(s) shall be requested as soon as
such variance requirement(s) is discovered or should have been discovered, but not
less than 30 days prior to submission of the final plat, from the developer outlining
the particulars on how the strict compliance of these regulations would cause him/her
extraordinary or unnecessary hardships, the planning commission may, after notice
and public hearing, vary certain parts of the regulations of this chapter, provided
that such variations will not have the effect of nullifying the intent and purpose
of the regulations, and provided the public interest, health, safety and general welfare
